Regulations on Order in Port
I BASIC PROVISIONS
Article 1
Pursuant to Article 1 and Article 3 of the Regulations on
conditions and ways of maintaining order in ports and in other parts of domestic
sea waters and territorial sea of the Republic of Croatia, and on borders of
boat sailing outside ports (Narodne novine, no. 91/94) and the Contract of
concession for maritime property for the purpose of economic exploitation of the
special purposes port - port of nautical tourism Tribunj, concluded on 26 March
2002, accredited for the concession, DANUVIUS MARINA d.o.o. Tribunj, passes
these Regulations on order in port of the nautical tourism port of Tribunj, for
the purpose of establishing and implementation of binding rules of conduct and
operation of all participants in the functioning of the port of nautical tourism
(hereinafter: port).
Article 2
Stated port area includes the area of 22,661.50 m2 of
land part and 40,162.70 m2 of sea part, which is totally
62,843.80 m2.
Article 3
DANUVIUS MARINA d.o.o. Tribunj is a nautical tourism port with
organized reception of 260 vessels for mooring in
the sea, and 150 vessels for accommodation on land.
II GENERAL PROVISIONS
Article 4
Provisions of these Regulations are applied to the personnel
and all service users of DANUVIUS MARINA d.o.o. Tribunj, as well as to other
entities that are within the territory and the waters of the marina.
Article 5
The director of DANUVIUS MARINA d.o.o. Tribunj is obliged to
put the text of the Regulations on order in port in an appropriate and prominent
place in the marina, and to directly inform of their content all persons obliged
to respect them or to enforce their provisions.
1. Authorized persons
Article 6
Authorized persons of the nautical tourism port DANUVIUS d.o.o
Tribunj for enforcement of the provisions of these Regulations are:
- director of the marina
- manager of the marina
Authorized persons must have boat operator's license or a
vocation of seaman-mechanic and a certificate for the vocation RTF with general
authority.
2. Determining spots for mooring vessels
Article 7
Authorized persons of DANUVIUS MARINA d.o.o. Tribunj for
determining spots for mooring vessels are the director and the manager of the
marina.
They determine a spot to moor a particular vessel following its
technical characteristics and the plan of mooring spots in the local port
waters.
The plan of mooring spots in the port waters of DANUVIUS
MARINA d.o.o. Tribunj determines berths for:
- boats - yachts on permanent berth
- boats - yacht for rent (charter)
- boats - yachts on daily berth (transit).
Article 8
Moving a vessel to another mooring spot in the waters of the
marina is done:
- upon the owner's request and by the decision of the
authorized persons of the marina,
- in coordination of the authorized persons and the
owner, and based on the need to move a vessel for the purpose of obtaining
optimal safety of the berth or fulfilling conditions for mooring other
vessels in the waters of the marina.
- in case of "force majeur", temporary moving of a
vessel can be done by an independent decision brought by the authorized
persons of the marina.
3. Entering port and mooring a vessel
Article 9
Before entering the port, the operator of the vessel is obliged
to announce entering the port by radio telephone on VHF channel 17.
Article 10
The management of the marina is obliged to put a table (white
background) on the breakwater head, on which there is an application of a
prominent warning (black letters) in the English language:
Speed limits 2 knots.
Article 11
The marina personnel on duty in the marina leads the vessel
entering the port by radio telephone messages and by showing signs with a flag
in the direction of the determined mooring spot, provides help in executing the
mooring procedure and directs the operator of the vessel to the reception office
of the marina.
Article 12
The operator of the boat is to enter the port carefully and by
the shortest route to the mooring spot which he is directed to, sailing on the
right hand side of the sailing route, without stopping, at speed not exceeding 2
knots.
Article 13
Upon entering the port or coming to the marina by land (road
traffic), operator of the vessel/owner of the vessel is obliged to register the
vessel's arrival at the reception office of the marina without delay, providing
valid vessel documents and personal documents of crew members.
Article 14
As a rule, vessels are moored with stern to the coastal line,
except on those mooring spots at which side mooring is planned.
Mooring is done using undamaged and neat ropes, prepared and
used according to good seamen custom and by putting fenders.
Moored ropes of one vessel must not interfere with the
maneuvering of the vessel on other mooring spots. Improperly moored vessels will
be moored by the marina personnel in proper way, at the expense of their owners.
Anchored (bow, as a rule) mooring rope is a property -
equipment of the marina and it is its obligation to maintain its proper
condition at its expense.
Article 15
It is the obligation of the marina to organize the records of
periodic examination of the mooring ropes of the vessel at berth in the marina,
and the worn out and defective ropes, belonging to a moored vessel (stern ropes,
as a rule), will be replaced with new ones by the marina personnel, at the
expense of the vessel owner.
Worn out bow ropes are replaced by new ones at the expense of
the marina.
4. Vessel's stay in the marina
Article 16
Preparation of the vessel to be consigned to the care of the
marina includes the following actions:
- disconnecting the electricity supply (it includes
both possible power sources: connection to land and to its own batteries)
- removing all flammable and explosive substances from
the vessel,
- putting its own fire extinguishers near the entrance
to the interior premises of the vessel,
- checking the level of the accumulated water in the
lower parts of the vessel,
- checking the good order and the safety of the
mooring of the vessel,
- removing the mobile equipment from the deck and open
parts of the superstructure and depositing it in the interior premises of
the vessel or delivering it for storage in the marina,
- making an up to date list of the vessel's inventory,
- Locking the entrance to the interior premises of the
vessel.
Article 17
Consigning the vessel to the care of the marina is considered
done when its operator executes preparatory actions provided by Article 16 of
the Regulations and when the following documents and things are delivered at the
reception office of the marina:
- license for sailing of the vessel (vignette),
- list of the vessel's inventory,
- photocopy of the obligatory insurance policy of the
vessel,
- keys to the interior premises of the vessel
- photocopy of the vessel owner's passport.
Article 18
By delivering the keys to the interior premises and the license
for sailing to the vessel owner or a person authorized by him, the
responsibility of the marina for the guarded vessel ceases, whether the vessel
stays in the marina or sails out of it.
Article 19
Connecting the vessel to the installation of electricity supply
from land is allowed using proper cable equipment, in accordance with the
declared electric power of the used socket at the electric cabinet in the
marina. Connection is allowed only when the crew is present on the vessel.
Article 20
Connecting the vessel to the installation of the fresh water
supply is allowed using the proper hose, and it is the obligation of the crew to
pull its connecting equipments to the vessel immediately after filling the water
tank.
Article 21
Parking of the vessel owner's vehicle is allowed only at marked
parking spots in the marina. If the owner is sailing out of the marina and is
leaving its vehicle at the parking lot, he is obliged to deliver the keys to the
vehicle at the reception office of the marina. Improperly parked vehicle will be
removed by the marina personnel at the owner's expense.
Article 22
Crews of the vessels staying in the marina are not
allowed to:
- start the propulsion system, except for maneuvering the
vessel with the possibility of monitoring its execution by the marina
personnel,
- leave the operating or ancillary engine or any other
technical device that uses gas or liquid fuel or electricity running when no
crew members are on board.
- move the vessel to another mooring spot in the
waters of the marina without the consent of the authorized persons in the
marina, set in Article 6 of these Regulations,
- empty the boat toilet devices or any boat waste
waters in the waters of the marina,
- keep tenders to the vessel, windsurf boards,
bicycles, satellite antennas or other equipment belonging to the vessel on
the pier, coast (promenade) or in the waters of the marina.
5. Sailing out of the marina
Article 23
The boat operator is obliged to report sailing out personally
at the reception office of the marina, except in case of emergency sailing out,
when he is allowed to report it by radio telephone communication.
The boat operator can request the assistance of the marina
personnel when sailing out, and they are obliged to provide help to any vessel
in case of difficult maneuvering conditions or bad weather conditions.
Article 24
The boat operator is obliged to sail out carefully and by
shortest route to the exit from the marina, sailing at the right hand side of
the sailing route, at speed not exceeding 2 knots.
6. Obligation to respect the rules of conduct in
the marina
Article 25
Operating all kinds of motor vehicles, motorbikes or bicycles
in the traffic areas of the marina is done fully respecting the traffic
regulations, in accordance to the put up vertical and horizontal signalization.
Parking is allowed only at the marked parking spots in the
marina, respecting the rules for the use of parking areas prescribed by the
management of the marina.
Article 26
Used waste oils, as well as all kinds of solid waste and home
garbage must be disposed exclusively in the marked allotted tanks positioned on
the territory of the marina.
Space for the positioning of used oil tanks must be fenced
impermeably in order to limit the pollution zone in cases of possible incident
while pouring or in case of penetration of the tank wall.
The marina personnel is obliged to keep the waste oil tank and
the surrounding area clean and to issue to the boat operator a receipt of
acceptance of waste oil and/or other waste taken from his vessel.
Article 27
Cleaning works and works on maintenance of the vessels and
their equipment can only be done in the marked part of the marina plateau, i.e.
"the service zone".
For all damages on neighbouring vessels, devices or equipment
that are the property of the marina, and for pollutions of the territory or
waters of the marina, the management of the marina will charge the owner of the
vessel on which the works during which the damage was caused were done.
The management of the marina will order the suspension of works
on a vessel if it determines the existence of the possibility of damaging the
property of the marina or of the third parties, and of pollution of the
territory of the waters of the marina.
Article 28
Vessels laid up are kept in a part of the plateau-space of the
dry berth in the marina determined for that purpose.
Article 29
In the marina, it is not allowed to:
- light an open fire,
- do welding works outside the service zone,
- keep on the vessel or anywhere in the area of the
marina, open or improper containers for storage of flammable and explosive
substances,
- pour, even in smallest quantities, oil or fuel into
the waters of the marina,
- throw or leave any waste inside the territory or the
waters of the marina,
- disturb the peace in the marina by noise or clamor,
especially between 11.00 pm and 7.00 am,
- anchor boats - yachts inside the waters of the
marina at their own anchor,
- swim in the waters of the marina,
- windsurf,
- ride the water scooters,
- sail at speed exceeding 2 knots,
- use the maritime radio telephone while the vessel is
at berth in the marina,
- move or stay at the manipulative space of dry berth
and inside the service zone (this refers to the third parties),
- let dogs and other animals move unleashed in the
marina.
7. Obligations of the management of the marina
Article 30
The management of the marina is obliged to organize and conduct
continuous safekeeping - surveillance of the vessels at berth in DANUVIUS MARINA
d.o.o. Tribunj.
Safekeeping - surveillance of the property of users is
conducted in accordance to the provisions of the Regulations on business of
DANUVIUS MARINA d.o.o. Tribunj, passed by the Management.
Article 31
The management of the marina is obliged to respect
environmental standards in conducting registered business activities, and to
provide conditions and conduct the protection of sea and environmental
activities for preservation of the sea resources and removing pollution.
In case of excess pollution in the area of the marina, the
management of the marina is obliged to immediately conduct procedures provided
for such situations, pursuant to Operative plan document passed by it.
Article 32
The management of the marina is obliged to organize the
participation in search and rescue operations at sea coordinated by the Harbor
Master's Office in charge, if there are presumptions for that, in all available
ways of help.
Article 33
The management of the marina is obliged to provide timely daily
weather report by the Maritime Weather Center in Split to the interested vessel
owners at berth in the marina.
Article 34
The management of the marina is obliged to put at disposal of
its users the "Book of complaints" in the reception office of the marina for the
purpose of possible declaring.
The "Book of complaints" must be at disposal of all users daily
during the working hours.
III FINAL PROVISIONS
Article 35
Regulations on order in port of the nautical tourism port DANUVIUS MARINA d.o.o.
Tribunj, takes effect on the date of verification by the Ministry of Maritime
Affairs, Transport and Communications, Harbor Master's Office Šibenik,
authorized to conduct the supervision of its application.
Article 36
In case of the repeated breach of provisions of these Regulations by the user of
a permanent berth in the marina, the Management of DANUVIUS MARINA d.o.o.
Tribunj can unilaterally cancel the concluded Contract of the use of berth in
Marina Tribunj.
